End User License Agreement
This End User License Agreement ("EULA") is a legal agreement between you ("End-User") and DoodleMania ("Licensor") for use of the DoodleMania mobile application ("Application"). By downloading or using the Application, you agree to be bound by the terms of this EULA.
1. License Grant
Licensor grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application solely on your personal Apple or Android device, strictly in accordance with this EULA.
2. Restrictions
You agree not to, and you will not permit others to:
- License, sell, rent, lease, assign, or distribute the Application.
- Modify, translate, adapt, or create derivative works or improvements of the Application.
- Reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive or gain access to the source code of the Application.
- Remove, disable, circumvent, or otherwise create or implement any workaround to any copy protection, rights management, or security features in or protecting the Application.
- Use the Application for any purpose that is illegal, harmful, or prohibited by this EULA.
3. Intellectual Property
The Application, including without limitation all copyrights, patents, trademarks, trade secrets, and other intellectual property rights are, and shall remain, the sole and exclusive property of Licensor.
4. Your Contributions
By submitting drawings, guesses, custom word packs, or other content through the Application, you grant Licensor a worldwide, royalty-free license to use, reproduce, modify, and display such content solely for operating and improving the Application. You represent that you have all necessary rights to grant this license.
5. Modifications to Application
Licensor reserves the right to modify, suspend, or discontinue, temporarily or permanently, the Application or any service to which it connects, with or without notice. You agree that Licensor will not be liable to you or any third party for any modification, suspension, or discontinuation of the Application or related services.
6. Term and Termination
This EULA is effective until terminated by you or Licensor. Your rights under this EULA will terminate automatically without notice from Licensor if you fail to comply with any term of this EULA. Upon termination, you must cease all use of the Application and delete all copies.
7. Disclaimer of Warranties
THE APPLICATION IS PROVIDED TO YOU "AS IS" AND WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, LICENSOR EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, REGARDLESS OF THE CAUSE OF ACTION AND WHETHER OR NOT LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LICENSOR'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THIS EULA WILL NOT EXCEED $100 USD.
9. Governing Law
This EULA is governed by the laws of the State of California, without regard to its conflict-of-law provisions.
10. Third-Party Beneficiary — Apple
If you obtained the Application from the Apple App Store, you acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
As between Licensor and Apple, Licensor, not Apple, is responsible for the Application and its content. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist-supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
